Collection and Consent Notice

By submitting this form and any biological samples for testing, you will provide your personal information to Sapient Nutrition Pty Ltd (ABN 19 645 588 530) (“vivaLAB”, “we” or “us”).

We will use and disclose the personal information you provide to us in the following ways:

On-boarding form

Testing kits and testing results

vivaLAB will rely on the personal information you submit via this on-boarding form to provide you with a personalised recommendation about your suitability for, and the potential benefits to you of, certain health products.

In order to provide that recommendation, we will de-identify your personal information and disclose it to health providers that we have contracted with to provide those services on our behalf.

If you choose not to provide some or all of the information we have requested in this on-boarding form, or if the information you provide is not accurate, we may not be able to provide you with those services to the same extent or at all.

vivaLAB will de-identify and send the biological samples that you submit to us in a testing kit to our third party testing providers.

Our third party testing providers will provide us with the results of the testing, and we will use those testing results to inform personalised recommendations we provide to you about your suitability for, and the potential benefits to you of, certain health products.

In order to provide that recommendation, we will de-identify your personal information and disclose it to health providers that we have contracted with to provide those services on our behalf.

We may also de-identify and store the biological samples you provide to us in a biobank facility on an indefinite basis.

If you choose not to provide the samples we require to conduct the testing, or if you do not agree to our testing providers providing us with the results of the testing, we may not be able to provide you with our services.

In addition to the above practices, any personal information that you provide to us or that we otherwise collect via the on-boarding form or as a result of the testing process may be:

disclosed by us to our contracted service providers who provide us with business, technology and corporate services, when reasonably required in order for those persons to provide services to us (including to support our Website); and
de-identified, and shared with our research partners and collaborators to undertake research, including for the development of nutraceuticals, diagnostic tools, medical devices and pharmaceuticals, as well as nutritional plans.

Generally, we will store your personal information in Australia. However, some of our contracted service providers who provide us with business, technology and corporate services are based (and host our data in) countries including the United States. Some of our current and future research partners and collaborators may also be located outside of Australia.

If we disclose your personal information to a third party outside Australia, we will take such steps as are reasonable in the circumstances to ensure that your personal information is protected and is handled by that third party in accordance with applicable privacy laws. We may also use or disclose your personal information for other purposes which are described in our Privacy Policy, which is available here www.vivalab.health/legal/privacy-policy.

Our Privacy Policy also includes details about:

how you can request access to and correction of the personal information we hold about you; and
how you can make a complaint about our privacy practices, including our compliance with our Privacy Policy or the Privacy Act 1988 (Cth), and how we will deal with any such complaint.
